Robert KIBUGI is a Partner of the Firm, and was admitted as an Advocate of the High Court of Kenya in 2006. Kibugi is also an Associate Professor of Law at the University of Nairobi. His professional credentials include a Doctor of Laws (LLD) degree from the University of Ottawa, and Master of Laws (LLM) and Bachelor of Laws (LLB) degrees from the University of Nairobi. Kibugi is an acclaimed practitioner and consultant in the spheres of land law and physical planning, environmental protection, natural resources management, climate change, human rights, and legislative and regulatory drafting.  Some select previous legal practice and consultancy engagements include: 

  • Leading the development of the 2023-2027 National Climate Change Action for Kenya, and providing advisory services to the Ministry of Environment, Climate Change and Forestry;
  • Undertaking vital roles in framing the technical aspects of mainstreaming human rights and biodiversity in a Post-2020 Global Framework as part of a collaborative effort involving Swedbio, International Development Law Organization (IDLO), Natural Justice, Office of the United Nations High Commissioner for Human Rights (OHCHR) and United Nations Environment Programme (UNEP), among other partners;
  • Conceptualising and drafting the legal aspects of Kenya’s 2013-2017 National Climate Change Action Plan (NCCAP);
  • Designing and drafting of the 2016 Climate Change Act of Kenya, and the National Climate Change Framework Policy of Kenya;
  • Development of Kenya’s Sessional Paper Number 1 of 2021 on the National Water Policy; development of regulations for the Water Act 2016 and drafting an amendment Bill for the same law;
  • Advising and guiding County Governments on legislative and policy drafting processes particularly the Mombasa, Laikipia and Elgeyo Marakwet Counties in respect to issues such as climate change, forestry, and water services;
  • Served as Legal Advisor on water sector reforms to Kenya’s Ministry of Water, with specific tasks that included supporting water and sanitation reforms involving County Governments, particularly the Mombasa County. The outcomes included the development of a Coastal Region Bulk Water Institutional framework, and the development of the Water Sector Transition Plan;
  • Structuring, drafting and reviewing real estate and conveyancing documents and deeds, and registration of property rights and interests;
  • Advising on and establishing estate management entities including management corporations and residents’ associations;
  • Providing guidance and advisory services to property developers including in respect to compliance with physical planning and construction laws and regulations, and application for pertinent permits and approvals.
